Miranda Fricker’s influential concept of epistemic injustice has recently seen application to many areas of interest, with an increasing body of healthcare research using the concept of epistemic injustice in order to develop both general frameworks and accounts of specific medical conditions and patient groups. This paper illuminates tensions that arise between taking steps to protect against committing epistemic injustice in healthcare, and taking steps to understand the complexity of one’s predicament and treat it accordingly. Work on epistemic injustice is (...) therefore at risk of obfuscating legitimate and potentially fruitful inquiry. This paper uses Chronic Fatigue Syndrome/Myalgic Encephalomyelitis as a case study, but I suggest that the key problems identified could apply to other cases within healthcare, such as those classed as Medically Unexplained Illnesses, Functional Neurological Disorders and Psychiatric Disorders. Future work on epistemic injustice in healthcare must recognise and attend to this tension to protect against unsatisfactory attempts to correct epistemic injustice. (shrink)

This study examined how structuring case-based ethics training, either through (a) case presentation or (b) prompt questions, influences training outcomes. Results revealed an interaction between case presentation and prompt questions such that some form of structure improved effectiveness. Specifically, comparing cases led to greater sensemaking strategy use and decision-ethicality when trainees considered unstructured rather than structured prompts. When cases were presented sequentially, structuring prompts improved training effectiveness. Too much structure, however, decreased future ethical decision making, suggesting that there can be (...) too much of a good thing when structuring case-based ethics education. A long lasting debate in the field of implicit learning is whether participants can learn without acquiring conscious knowledge. One crucial problem is that no clear criterion exists allowing to identify participants who possess explicit knowledge. Here, we propose a method to diagnose during a serial reaction time task those participants who acquire conscious knowledge. We first validated this method by using Stroop-like material during training. Then we assessed participants’ knowledge with the Inclusion/Exclusion task and the wagering task . Both (...) experiments confirmed that for participants diagnosed as having acquired conscious knowledge about the underlying sequence the Stroop congruency effect disappeared, whereas for participants not diagnosed as possessing conscious knowledge it only slightly decreased. In addition, both experiments revealed that only participants diagnosed as conscious were able to strategically use their acquired knowledge. Thus, our method allows to reliably distinguish between participants with and without conscious knowledge. (shrink)

Objective Standards of care regarding obstetric management of life-threatening anomalies are not defined. It is hypothesised that physicians' management of these pregnancies is variable and influenced by demographic factors. Design A questionnaire was mailed to members of the Society of Maternal–Fetal Medicine with valid US addresses assessing obstetric management of both ‘uniformly lethal’ (eg, anencephaly, renal agenesis) and ‘uniformly severe, commonly lethal’ (eg, trisomy 13 and 18) anomalies. Respondents were asked to answer as if not limited by state/institutional restrictions. Fisher's (...) exact or χ2 tests were used as appropriate and correction made for multiple comparisons in analyses that were not prespecified. Results The response rate was 36% (732/2038). Nearly 100% of respondents discuss termination for both uniformly and commonly lethal anomalies. In continuing pregnancies, with patient request for obstetric non-intervention 99% of providers would comply for either uniformly or commonly lethal anomalies. The majority ‘encourage’ such management, but some were non-directive or discouraged this management. In continuing pregnancies, with patient request for full obstetric intervention the majority of respondents was willing to comply for both uniformly (71%) and commonly (82%) lethal anomalies. While most practitioners ‘discouraged’ full intervention, some were non-directive or encouraged this management. Demographics and severity of anomaly influenced counselling. Conclusion Discrepancies exist regarding the management of life-threatening fetal anomalies. Patients may be offered different options based on practitioner demographics. The majority of physicians comply with patient wishes. Differences were noted when comparing the management of lethal with that of severe commonly lethal anomalies, suggesting that practitioners make a distinction when counselling patients. (shrink)

Background: This study developed a photo and video database of 4-to-6-year-olds expressing the seven induced and posed universal emotions and a neutral expression. Children participated in photo and video sessions designed to elicit the emotions, and the resulting images were further assessed by independent judges in two rounds. Methods: In the first round, two independent judges, experts in the Facial Action Coding System, firstly analysed 3,668 emotions facial expressions stimuli from 132 children. Both judges reached 100% agreement regarding 1,985 stimuli, (...) which were then selected for a second round of analysis between judges 3 and 4. Results: The result was 1,985 stimuli were produced from 124 participants. A Kappa index of 0.70 and an accuracy of 73% between experts were observed. Lower accuracy was found for emotional expression by 4-year-olds than 6-year-olds. Happiness, disgust and contempt had the highest agreement. After a sub-analysis evaluation of all four judges, 100% agreement was reached for 1,381 stimuli which compound the ChildEFES database with 124 participants and 51% induced photographs. The number of stimuli of each emotion were: 87 for neutrality, 363 for happiness, 170 for disgust, 104 for surprise, 152 for fear, 144 for sadness, 157 for anger 157, and 183 for contempt. Conclusions: The findings show that this photo and video database can facilitate research on the mechanisms involved in early childhood recognition of facial emotions in children, contributing to the understanding of facial emotion recognition deficits which characterise several neurodevelopmental and psychiatric disorders. Background The first COVID-19 wave started in February 2020 in France. The influx of patients requiring emergency care and high-level technicity led healthcare professionals to fear saturation of available care. In that context, the multidisciplinary Ethics- Support Cell (EST) was created to help medical teams consider the decisions that could potentially be sources of ethical dilemmas. Objectives The primary objective was to prospectively collect information on requests for EST assistance from 23 March to 9 May 2020. The secondary aim was (...) to describe the Cell’s functions during that period. Research design This observational, real-time study of requests for Cell consultations concerned ethical dilemmas arising during a public health crisis. The EST created a grid to collect relevant information (clinical, patient’s/designated representative’s preferences and ethical principles strained by the situation), thereby assuring that each EST asked the same questions, in the same order. Participants and research context Only our university hospital’s clinicians could request EST intervention. Ethical considerations The hospital Research Ethics Committee approved this study (no. CER-2020-107). The patient, his/her family, or designated representative was informed of this ethics consultation and most met with EST members, which enabled them to express their preferences and/or opposition. Findings/results 33 requests (patients’ mean age: 80.8 years; 29 had COVID-19: 24 with dyspnea, 30 with comorbidities). 17 Emergency Department solicitations concerned ICU admission, without reference to resource constraints; others addressed therapeutic proportionality dilemmas. Discussion Intervention-request motives concerned limited resources and treatment intensity. Management revolved around three axes: the treatment option most appropriate for the patient, the feasibility of implementation, and dignified care for the patient. Conclusions COVID-19 crisis forced hospitals to envisage prioritization of ICU access. Established decision-making criteria and protocols do not enable healthcare professionals to escape ethical dilemmas. That acknowledgement highlights ethical risks, enhances the added-value of nursing and encourages all players to be vigilant to pursue collective deliberations to achieve clear and transparent decisions. The focus of this paper is a possible Siberian link with the Na-Dene Languages, based on cognitive lexical semantics. Dene-Yeniseian is a proposed language family consisting of the Yeniseian languages of Central Siberia and the Na-Dene languages of North-Western North America. The paper connects semantic universals, Ket and Dene folklore, and also comparative historical linguistic research. In analyzing a group of cognates, the paper’s aim is to discuss the cultural, cognitive and pragmatic reasons that enabled these cognates to survive for (...) several thousand years. Our main point is that factors such as the relative importance of linguistic signs in a language community, lingual conservatism of semantic universals and the distinctiveness of its referents, probable frequency with which these words were used, and their cultural symbolism in relatively similar environments significantly contributed to their survival in ethnic groups belonging to the proposed language family. Our cross-disciplinary study helps us identify the essential place of eco-ethnic material in interpreting cross-continental similarities and emphasizes the integrative role of culture. It will be argued that the eco-ethnic lexicon reflected by the Dene-Yeniseian cognates reveals several thousand years of diachronic cognitive processes. (shrink)

While the impact of the work of Peirce (...) on theses sciences is weak, the integration of the sciences in his philosophy is interesting as a step in the history of science and his work is an example for ecclecticism and historism of science in the 19th century and the universalism of science deducted from a philosophy that uses the sign as an unitarian principle. El juicio clínico se ha convertido en un tópico capital para la filosofía de la medicina y la profesión médica desde los sesenta. Tras el desarrollo de la medicina basada en la evidencia en los noventa, se espera una mayor sensibilidad en el juicio clínico frente a las necesidades y preferencias de los pacientes ante las amenazas de enfoques positivistas, que, se considera, descuidan la individualidad. Este artículo aborda este problema a la luz de una filosofía de la medicina más (...) sensible a los componentes históricos de la epistemología, la ontología y la ética. Se dirige la mirada al siglo XIX para dilucidar las tensiones en torno al lugar de los conocimientos médicos y la apuesta por dotar al juicio clínico de nuevos métodos para la mejora profesional. Este retorno al pasado ayuda a comprender las transformaciones actuales del campo de la medicina, especialmente en cuanto a cómo ayudan a constituir nuevos tipos de pacientes, nuevos tipos de ethos profesional y nuevas formas de relación entre dichos actores. Until now, North American and European philosophies have been engaged in debates about the possibility of a postmetaphysical philosophy and the consequences of the linguistic turn for the assessment of modernity; they have done so, however, without departing from the narrow horizons of their respective nationalistic perspectives. In this incisive critique, Dussel demonstrates how most of thse philosophies have either failed to give historically faithful analyses of the genesis of the "myth" of modernity, or have never engaged in a serious (...) questioning of their own Eurocentric presuppositions. He shows how North American and European philosophers have presupposed a no-longer-acceptable philosophy of history that has led them to fall into a "developmental fallacy," the belief that there is a linear sequence that moves from the premodern, underdeveloped, or on the way to industrialization, to the modern, developed, and industrialized. El presente trabajo realiza un análisis de los usos de la cartografía pedagógica, centrándose en artículos científicos que registran la experiencia de maestros en educación formal, identificando cómo la han aplicado, en quiénes la han desarrollado y qué implicaciones sociales y educativas ha tenido en los lugares donde se ha implementado. Se examinó un total de 90 publicaciones entre 2017 a 2022, de diferentes países, identificando aciertos, hallazgos, y oportunidades que presenta esta metodología. The aim of this paper is to propose a systematic classification of emotions which can also characterize their nature. The first challenge we address is the submission of clear criteria for a theory of emotions that determine which mental phenomena are emotions and which are not. We suggest that emotions as a subclass of mental states are determined by their functional roles. The second and main challenge is the presentation of a classification and theory of emotions that can account for (...) all existing varieties. We argue that we must classify emotions according to four developmental stages: 1. pre-emotions as unfocussed expressive emotion states, 2. basic emotions, 3. primary cognitive emotions, and 4. secondary cognitive emotions. We suggest four types of basic emotions (fear, anger, joy and sadness) which are systematically differentiated into a diversity of more complex emotions during emotional development. The classification distinguishes between basic and non-basic emotions and our multi-factorial account considers cognitive, experiential, physiological and behavioral parameters as relevant for constituting an emotion. However, each emotion type is constituted by a typical pattern according to which some features may be more significant than others. Emotions differ strongly where these patterns of features are concerned, while their essential functional roles are the same. We argue that emotions form a unified ontological category that is coherent and can be well defined by their characteristic functional roles. Our account of emotions is supported by data from developmental psychology, neurobiology, evolutionary biology and sociology. (shrink)

Empirical studies indicate that business compliance with the UK Modern Slavery Act is disappointing, but they struggle to make sense of this phenomenon. This article offers a novel framework to understand how business organizations construct the meaning of compliance with the UK Modern Slavery Act. Our analysis builds on the endogeneity of law theory developed by Edelman. Empirically, our study is based on the analysis of the modern slavery statements of 10 FTSE 100 (Financial Times Stock Exchange 100 Index) companies (...) in the food and tobacco sector, backed by interviews with business, civil society, and public officers. We offer a dynamic model that draws attention to the role of compliance professionals in framing ambiguous rules and devising a variety of organizational responses to modern slavery law. Contrary to extant research that tends to praise organizations for going “beyond compliance”, our study underlines the risks of managerialization of modern slavery law, whereby merely symbolic structures come to be associated with legal compliance, even when they are ineffective at tackling modern slavery. This article focuses on Karl Jaspers’s notion of the Axial Age, some of its critical appropriation, and how in particular Habermas has returned to this idea, after several critical engagements with Jaspers’s work through his long scholarly productivity. The article, however, centers on Habermas’s selective and critical use of Jaspers’s notion in his own latest and extensive engagement with what he calls “a genealogy of postmetaphysical thinking.” The goal of the article is to identify the ways in which Habermas is (...) refurbishing Jaspers’s generative concept, but at the same time, how his work on postsecular consciousness opens itself to some liabilities by not taking enough distance from the concept. We can now survey the ruins of a Babelian tower of discourse about cosmopolitanism. We speak of “elite travel lounge,” “Davos,” “banal” as well as of “reflexive,” “really existing,” “patriotic,” and “horizontal” cosmopolitanisms. Here, an attempt is made to extract what is normative and ideal in the concept of cosmopolitanism by foregrounding the epistemic and moral dimensions of this attitude towards the world and other cultures. Kant, in a rather unexpected way, is profiled as the exemplification of what is here (...) called “imperial” cosmopolitanism, which is both blind and dismissive of its own material conditions of possibility. Then, through a discussion of the works of Nussbaum, Appiah, Mignolo, Butler, Benhabib and Beck the author elaborates a version of cosmopolitanism that is grounded, enlightened, and reflexive, which corrects and supersedes Kant’s own Eurocentric cosmopolitanism. We do not live in an age of cosmopolitanism, but in an age of cosmopolitization. Democratic iterations that are jurisgenerative are matched at the global level by cosmopolitan iterations that are both jurisgenerative and affect generating. (shrink)

It is uncontroversial that something goes wrong with the blaming practices of hypocrites. However, it is more difficult to pinpoint exactly what is objectionable about their blaming practices. I contend that, just as epistemologists have recently done with blame, we can constructively treat hypocrisy as admitting of an epistemic species. This paper has two objectives: first, to identify the epistemic fault in epistemically hypocritical blame, and second, to explain why epistemically hypocritical blamers lose their standing to epistemically blame. I tackle (...) the first problem by appealing to an epistemic norm of consistency. I address the second by arguing that the epistemically hypocritical blamer commits to an opting-out of the set of shared epistemic standards that importantly underlies our standing to epistemically blame. I argue further that being epistemically hypocritical undermines a blamer’s standing even to judge epistemically blameworthy. (shrink)

This article deals with the concepts, processes, and antagonisms that are associated with the notion of postsecularity. In light of this article’s expanded interpretation of José Casanova on the secular and secularization, as well as thoughts on James A. Beckford’s take on public religions, five rubrics on the postsecular derived from critical theory and an understanding of ‘reflexive secularization’ are presented. This term focuses on secularization processes and how these practices unleash complementary as well as antagonistic tendencies, a confrontation of (...) normativities and specific social-empirical challenges. From this basis it is argued that social-empirical analysis should focus on non-naturalistic relations between individuals occupying structurally equivalent positions in narrative networks. A plurality of normativities are seriously considered as ideas circulating through social relations where the critical competence of the participants of such communication processes are provoked to subvert anything – including any normative positionality – as taken for granted. Moves towards the decolonization of the secular/postsecular dyad are emphasized, with ramifications for thinking about the urban, which point to the universal and authentic foundations of the human condition that are brought into play. Recent empirical studies have established that disgust plays a role in moral judgment. The normative significance of this discovery remains an object of philosophical contention, however; ‘disgust skeptics’ such as Martha Nussbaum have argued that disgust is a distorting influence on moral judgment and has no legitimate role to play in assessments of moral wrongness. I argue, pace Nussbaum, that disgust’s role in the moral domain parallels its role in the physical domain. Just as physical disgust tracks physical contamination and (...) pollution, so moral disgust tracks social contamination. I begin by examining the arguments for skepticism about disgust and show that these arguments threaten to overgeneralize and lead to a widespread skepticism about the justifiability of our moral judgments. I then look at the positive arguments for according disgust a role in moral judgment, and suggest that disgust tracks invisible social contagions in much the same way as it tracks invisible physical contagions, thereby serving as a defense against the threat of socio-moral contamination. Este tratado se idea con una clara finalidad instrumental, pues el autor deseaba entrar al servicio de Isabella d’Este, marquesa consorte de Mantua. Precisamente por ello, tras cada uno de los argumentos que Equicola presenta y detrás de cada una de las mujeres ejemplares que menciona para ensalzar el valor femenino a lo largo de la historia se pueden establecer (...) paralelismos más o menos claros con los problemas que Isabella tuvo que afrontar en su primera década en la corte mantuana. En este artículo analizamos la función que Veturia desempeña en el seno del elenco de mujeres ejemplares del _Perigynaecon_ y profundizamos en algunos de los motivos que podrían haber empujado a Equicola a decantarse por incluir a la madre de Coriolano entre las mujeres a las que alude en su tratado. Eighteenth-Century Stoic Poetics: Shaftesbury, Akenside, and the Discipline of the Imagination offers a fresh perspective on the eighteenth-century poetics of Lord Shaftesbury and Mark Akenside. This book traces the two authors' debt to Roman Stoic spiritual exercises and early modern conceptions of the care of the self, which informs their view of the poetic imagination as a bundle of techniques designed to manage impressions, cultivate right images in the mind and rectify judgement. Alexandra Bacalu traces the roots of this (...) articulation in early modern writings on the imagination, as well as in Restoration and Augustan debates on wit, exploring the fruitful tension between ideas of imaginative enthusiasm and imaginative regulation that it provokes.
